ADA Logistics, Corp. Work Rules

 

The following Work Rules have been implemented by ADA Logistics, Corp. These Work Rules are in accordance with rules and regulations established by the Federal Motor Carrier Safety Administration (FMCSA) and the U.S. Department of Transportation.

Accidents

  1. Major preventable accident after full investigation:
  • Termination of employment.
  1. Minor preventable accident after full investigation: (See Notes # 1)
  • 1st occurrence: Reprimand.
  • 2ndoccurrence: Termination.
  1. Conviction of a moving violation that results in a fatality:
  • Termination of employment.
  1. Failure to report any/all accidents, personal injury, spillage or contamination:
  • Termination of employment.

 

Equipment

  1. Failure to report mechanically defective condition of equipment on a daily vehicle inspection report:
  • 1st occurrence: Reprimand.
  • 2ndoccurrence: Termination.
  1. Unauthorized use of a motor vehicle:
  • Termination of employment.
  1. Failure to report breakdowns promptly:
  • 1stoccurrence: Reprimand.
  • 2ndoccurrence: Termination.
  1. Deliberate or willful damage to Equipment:
  • Termination of employment and Reimbursement of damaged equipment.
  1. Failure to keep Periodic (annual) inspection current:
  • Unit is parked (No dispatch).
  1. Failure to perform and/or submit vehicles (truck and trailer) Monthly Maintenance Reports:
  • 1stoccurrence: Reprimand, $100.00 fine and no dispatch.
  • 2ndoccurrence: Termination.
  1. Failure to perform and/or submit scheduled PM (truck and trailer) when due:
  • 1stoccurrence: Reprimand, $100.00 fine and no dispatch.
  • 2ndoccurrence: Termination.

 

Conduct

  1. Use or possession of drugs or alcohol beverage while on duty, in vehicle, or on company property:
  • Termination of employment.
  1. Evidence of drinking prior to reporting for duty, within the limits set by the FMCSR:
  • Termination of employment.
  1. Testing Positive for any controlled substance or Alcohol test:
  • Termination of employment.
  1. Discourtesy to customers:
  • 1st occurrence: Subject to discharge.
  • 2nd occurrence: Termination.
  1. Theft:
  • Termination of employment and reimbursement of stolen equipment/belongings.
  1. Failure to follow order of dispatch, supervisor, or safety department:
  • 1st occurrence: Reprimand.
  • 2nd occurrence: Termination.
  1. Ticket for reckless driving, texting and using hand held phone while driving, making improper or erratic lane changes, following the vehicle ahead too closely, and speeding 6 mph or more above the speed limit:
  • 1st occurrence: Termination and $1,500.00 fine.
  1. Ticket for a non-serious moving violation (speeding less than 6 mph, improper turn, lane restriction, failure to obey traffic control device):
  • 1st occurrence: Reprimand and $300 per violation up to $600 per inspection.
  • 2nd occurrence: Termination.
  1. Violating an out-of-service order:
  • Termination of employment and $1,000.00 fine.
  1. Filing of a false employment application:
  • Termination of employment.
  1. Leaving equipment unattended when loading or unloading:
  • 1stoccurrence: Reprimand.
  • 2ndoccurrence: Termination.
  1. Failure to complete all reports, trip sheets and daily vehicle inspection reports. Failure to forward logs as mandated by the FMCSR(13days):
  • 1stoccurrence: Reprimand, $50.00 fine and no dispatch.
  • 2nd occurrence: Termination.
  1. Out-Of -Service order from a roadside inspection (Driver Out-Of-Service)
  • 1st occurrence: Reprimand and $1,000.00 fine:
  • 2nd occurrence: $1,500.00 fine.
  • 3rd occurrence: $2,000.00 fine followed by Termination.
  1. A non Out-Of-Service violation of the 11 driving, 14 hour shift, 70 hour rule, false logs, 30 min break in 8 hours on duty, general form and manner from a roadside inspection:
  • 1st occurrence: Reprimand and $300.00 per violation up to $600.00 per inspection.
  • 2ndoccurrence: $600.00 penalty fee per violation up to $600.00 per inspection.
  • 3rd occurrence: $1,000.00 penalty fee followed by Termination.
  1. Driver’s ELD is not in compliance with DOT regulations:
  • Per occurrence: driver will be charged with $500.00 as internal penalty fee and one (1) day no dispatch when his/her ELD shows driver’s violation.
  1. Unauthorized passenger(s):
  • Termination of employment
  1. Exceeding 10% violations of the 11-hours driving rule, 14-hours shift rule, on duty 70 hour in 8 consecutive days, or falsification of logs in any calendar month period:
  • 1st occurrence: Reprimand and $300.00 per violation up to $600.00 per inspection.
  • 2nd occurrence: $600.00 per violation up to $600.00 per inspection and one (1) day no dispatch.
  • 3rd occurrence: $600.00 penalty fee followed by Termination.
  1. Failure to notify the safety department when placed Out-Of-Service:
  • 1st occurrence: Termination.
  1. Using or equipping a CMV with radar detector:
  • 1st occurrence: Termination.
  1. A non Out-Of-Service violation(s) from a roadside inspection (Vehicles):
  • Per occurrence: Reprimand and $300.00 per violation up to $600.00 per inspection.
  1. Out-Of -Service order from a roadside inspection (Vehicle Out-Of-Service):
  • 1st occurrence: Reprimand and $1,000.00 penalty fee.
  • 2nd occurrence: $1,000.00 penalty fee and one (1) day no dispatch.
  • 3rd occurrence: $1,500.00 penalty fee followed by Termination.
  1. Failure to forward roadside inspection report to company:
  • 1st occurrence: Termination.
  1. Canceling the load, that was previously booked (accepted with the rate confirmation), is allowed only when problems occurs with the vehicle(s). In case of cancellation, we will need shop receipt to justify cancelation with our customer. Canceling the previously booked load (accepted with the rate confirmation) without shop receipt(s) will result in:
  • 1st occurrence: $300.00 penalty fee.
  • 2nd occurrence: $500.00 penalty fee and two days NO DISPATCH.
  • 3rd occurrence: $1,000.00 penalty fee followed by Termination.

 

Notes

  1. A Minor preventable accident is an accident with a cumulative damage of $ 20,000.00 or less of all the vehicles involved in the accident.
  2. An occurrence, for the sake of progressive disciplinary action, will end 365 days from the date of the last occurrence. The exception to this is P under conduct which will end 180 days from the date of the last occurrence.
  3. Rule P under conduct refers to auditing of logs for hours-of-service. ADA Logistics, Corp. will audit logs for these violations.
  4. Ticket under Conduct for items G and H includes warnings in any inspection report.
  5. Failure to forward logs as mandated by the FMCSR(13days) will result in delay of settlements until logs are forwarded to the office.
  1. Section P under Conduct is effective 19 Dec 2014. All other work rules are effective 19 Dec 2014
  2. A reprimand is a written warning.
  3. At any time, CARRIER reserves the right to make changes to above policies (Work Rules) and charges at CARRIER’s discretion.

Terms and conditions for receiving SMS (text messages)

 

ADA Logistics Corp. uses text messages as a way to communicate with truck drivers working for us. Communication with customers is strictly done over email and phone calls. We will use text messages to get updates from our drivers about their location, status of the load being delivered. Drivers may use our text line to request assistance, give us updates on loads, inform us of incurring roadside inspections and/or any other work-related situations.

ADA Logistics, Corp. will request a verbal consent from you for receiving text messages. Consent for receiving text messages will be obtained by one of our employees over a phone call. By giving your consent to receive messages from ADA Logistics, Corp. you acknowledge and understand the following and agree to be bound by these Terms and Conditions.

 

(A) By providing your phone number to ADA Logistics, Corp. you are authorizing ADA Logistics, Corp. (or a third-party agency on behalf of ADA Logistics, Corp.) to send text messages to your mobile number.

(1) Job Application/Onboarding Process Text Messages – By providing your phone number on your job application, you acknowledge, understand and agree to the following:

(i) No Limit. You acknowledge ADA Logistics, Corp. may send you a text message pertaining to your job application or the onboarding process at any time and there is neither a minimum nor a maximum number of text messages you may receive. For these types of text messages, text message frequency may vary by candidate.

(ii) Opt out. You may cancel your consent to this text message service at any time. If you no longer want to receive such text messages, you can respond to any text message you receive from ADA Logistics, Corp. by texting in the word STOP. You may also send us an email or call us.

(iii) Assistance. For assistance, you may text the word HELP to any text message you receive from ADA Logistics, Corp., call us at (817) 458-4188 or email [email protected].

(B) You represent and warrant that you are the lawful owner of the phone or device that will receive the text messages. If your contact information changes, you will immediately notify us of your new contact information.

(C) You understand that text messaging services may not be available at all times and in all areas. ADA Logistics, Corp. is not responsible for text messages that you do not receive for any reason. Carriers are not liable for delayed or undelivered messages.

(D) Standard message rates may apply from your mobile service or wireless device carrier for text messages you send or receive. These rates may be charged by your mobile service or wireless device provider, and would be payable by you. Such mobile service or wireless device carrier shall not be liable for any undelivered messages or delays in the receipt of the text messages discussed in these Terms and Conditions.

(E) You knowingly and voluntarily: (a) agree to indemnify, defend, and hold ADA Logistics, Corp. harmless from and against any and all losses, complaints, demands, claims, or causes of action, liabilities, costs, judgments, damages, fines, penalties, wages, compensation, attorney’s fees, and expenses of any kind, including any and all types of injuries and/or damages suffered by you, which arise as a result of (or are related to) the text messaging services, and (b) agree not to sue, or cause any lawsuit, complaint, claim, or charge to be filed on your behalf against ADA Logistics, Corp. with respect to any such damages.

(F) Custom-branded domain URL shorteners are permitted; public URL shorteners, such as bitly and tinyurl, are prohibited.

(D) Domains must be registered email addresses and not publicly available free domains such as gmail.com or outlook.com.
